Terms and Conditions

 

We sincerely invite retail companies and other business entities interested in reselling the goods offered in our online wholesale shop to cooperate with us.

 

We do not carry out sales for CONSUMERS!

A consumer, according to the definition given by the Polish Office of Competition and Consumer Protection, is a natural person who performs a legal transaction (e.g. conclusion of a contract) that is unrelated directly to his/her economic or professional activity.

 

In order to start trading with us, you will need to register on the www.mada.pl website using this registration form and subsequently send us the documents confirming the registration details of your business (you can do this either directly via e-mail: hurtownia@mada.pl, or using fax: +48-89-532-08-45).  Depending upon your country of residence, the exact character of the documentation will vary (e.g. EU VAT number), please provide the necessary documents confirming that your company is a legitimate business.

Once the above mentioned documents have been received and verified, we will send you (via e-mail) the confirmation of registration.  From this moment onwards, you will be granted full access to our online offer, and you will be able to place orders (once logged in using the e-mail address and password provided in the registration form).

The current patrons of MADA, who wish to use the online shopping service, are kindly requested to tick the ‘warehouse customer’ box while completing the registration form. You will receive the registration confirmation without the need to send us the documentation confirming business registration.

Prior to placing an order, we kindly ask you to familiarise yourself with the terms and conditions. Placing an order shall constitute your acceptance of these terms and conditions.

 

Re-using product images (e.g. in internet auctions) found on the www.mada.pl website is forbidden.


 

Orders and dispatch

 

  1. All prices provided are net prices and do not include VAT.

  2. Each transaction is confirmed by a VAT invoice attached to the shipment.

  3. Orders are taken 24 hours a day, 7 days a week.

  4. Order processing and dispatch takes place from Monday to Friday between 8am and 4pm.

  5. Goods that are in stock will be dispatched within 48 hours from receiving the payment. If you choose to pay on delivery the same rule applies. Cash on delivery is only available to domestic customers.

  6. If any of the goods ordered are out of stock, we will notify you immediately via e-mail or by phone.

  7. The customers are requested to pay for their purchases, once they receive order confirmation from our employee.

  8. Minimum order value for domestic customers is PLN 500 net, foreign must exceed PLN 2,000 net.

  9. Goods are delivered by GLS parcel delivery company.

  10. We cover the delivery costs on the territory of the Poland if the value of the order exceeds PLN 900.00 net (PLN 1107.00 gross), a delivery below this value shall be paid by the receiver - PLN 15.98 net (PLN 19.66 gross). (Does not apply to shipping outside Poland)

  11. In the case of choosing the option of payment for goods on delivery, the cost of delivery 3.00 PLN (3.69 PLN gross) is added (We do not send cash on delivery shipments outside Poland)

  12. Additional VAT invoices for the delivery costs are attached to all orders.

  13. Shipping costs for international orders are covered by the customer.

  14. The maximum weight of one package amounts to 30 kg. If the ordered goods do not fit into a single package and the customer covers the delivery costs, the goods will be packed into separate packages, and we will charge the customer with an additional fee of PLN 19.66 gross for each package.

Complaints

Complaints on deliveries received from the warehouse through transport companies.

  1. If the delivery is damaged or if any attempts to open it are visible (the delivery is taped with a tape other than the one from our company), a damage protocol must be drawn up unconditionally in the courier's presence. Otherwise, the quantitative complaints or those relating to the state of packaging shall not be examined.
  2. If the package is picked up without external damage and after its opening, it turns out that the goods contained therein are not suitable for purchase or the packing is damaged, it is necessary to draw up the protocol. The protocol should contain the following information:
    • type and quantity of the goods
    • damage type
    • cause of the damage
    • waybill number
    The protocol should be handed over as soon as possible to our company by post or by e-mail.
  3. Any quantitative and qualitative complaints, as well as those concerning the value of received goods according to the previously made wholesale orders shall be examined within 14 days from the day of issuing the sale document.
    After this deadline, the complaints shall not be examined.

Complaints on used goods

  1. All complaints covered by the manufacturer's warranty and guarantee shall be examined pursuant to the Act of 23.04.1964, Polish Civil Code, consolidated text of 26.09.2016 (Polish Journal of Laws, 2016 item 380).
  2. Complaints on used goods without correctly filled complaint notifications shall not be examined. Example of a complaint notification to download here (docx, pdf).
  3. The good subjected to a complaint should be prepared for the complaint (clean). Otherwise, it will be sent back without examining the complaint.

Safety and confidentiality

  • Placing an order confirms your consent to retain your company information in our system for the exclusive purposes of customer support and order realization. This information will not be used for any other purposes and will not be shared with any other entities.
  • Once logged in, all customers have the right to alter their personal details.

Cookie files

The "cookie" files are files or part of information that may be stored on your computer (or another unlocked device, such as tablet or smartphone), when you visit the mada.pl website. A cookie usually comprises the name of the website from which it originates, the “lifespan” of the cookie (meaning the time of its existence) and a value which is usually a randomly generated unique number.

Data collection

In accordance with the established practice of most web services, we store the HTTP requests addressed to our server. That means that we know the public IP addresses from which the users browse the information content of our service. The browsed resources are identifiable by the URL addresses. We also know:

  • the requested arrival time,
  • the response sending time,
  • the name of the customer's station - identification made through the HTTP protocol,
  • information on errors that occurred while conducting the HTTP transaction,
  • the URL address of a website previously visited by the user (referer link) in case when the user has been redirected to the Office’s website through a link,
  • information from the user's browser.

These data are not associated with specific persons browsing the mada.pl service. In order to ensure the highest quality of service, we occasionally analyse files with logs in order to determine which sites are the most visited, which websites browsers are used, whether the website structure does or doesn't contain errors, etc.

Use of the data   

The collected logs are stored for an unlimited period of time as auxiliary material that serves to administer the system. The information that they contain is not revealed to anyone apart from persons authorised to administer the service. On the basis of log files, it is possible to generate statistics helping in administration. The overall summaries in the form of such statistics do not contain any features identifying the persons visiting the service.

Types of cookie files and their use

Session cookies
The cookie files enabling to save the choices made by the User and used, for example while logging in, remain on the user’s device until the logout from the service or closing the browser.
Cookie files serving for analyses
Cookie files enabling to collect data related to the way of use of the website, including contents clicked by the user while browsing the website and enabling to improve the functioning and the structure of the service.
Cookie files used for targeting
Cookie files saving the information on use of the website, enabling offering promotions and other information adjusted to the customer's preferences.

Cookie files management

Available Internet browsers accept cookie files in their initial settings. However, every user has the right to refuse to set cookie files on his or her end device. As a rule, in order to change these settings, it is necessary to disable the cookie file mechanism in a given Internet browser, both on computers, smartphones and any other devices. These settings may be changed, in particular, in such a way as to lock the automatic handling of cookies in the Internet browser settings or to notify every time on setting them on the Service user’s device. Detailed information on possibilities and ways of handling of the cookie files are available in the software settings (of the Internet browser). It is worth noting though that the removal of cookie files may lead to a loss of possibility to use the essential functionalities of the Service.

Responsibility

Mada Sp. J. does not hold responsibility for damage of any nature resulting from external causes, this includes:

  • orders placed by a someone else than the account holder;
  • failure to meet delivery date, namely: production interruptions, loss of profit or indirect losses resulting from the failure to deliver the relevant goods in time, except for individual agreements with MADA Sp. J. in which the conditions of supply and responsibility for its failure are defined;
  • differences in the appearance or the colours of products received due to technical reasons such as using different computer displays;
  • late delivery of parcels caused by the parcel delivery company.

The product catalogue on the www.mada.pl web site does not constitute an offer as laid out in the Civil Code Acts art.71.

In case of matters which are have not been described by the above terms and conditions, the Civil Code Act applies.
